​AGREEMENT FOR USE OF PRiS SERVICES

This is an agreement between the Peace Region Internet Society ("PRiS") and you ("the User"), for the use of services provided by PRiS ("the Services").

1. AGREEMENT
PRiS agrees to provide Services relating to an Internet connection ("the Connection") and related hardware and software ("the Services") to the User and the User agrees to use the Services only in accordance with the terms and conditions of this Agreement.
2. NO LIABILITY FOR CONTENT

PRiS does not exercise control over the content passing through the Connection, and makes no warranties relating to the Services, merchantability or fitness for any purpose of the Services, protection of any kind, whatsoever that might be transmitted to or from, or stored by the User, in connection with the User's use of the Services (which information is referred to herein as "User Data").
3.USE SUBJECT TO PRiS POLICIES

The User shall use the Servers only in accordance with this Agreement and the PRiS Acceptable Use Policy as published at http://www.pris.ca/acceptableuse  The User shall not transmit any User Data in violation of any Canadian or other applicable legislation, contrary to any copyright laws, laws relating to obscenity, or any international laws, agreements or conventions relating to the restriction of exporting or disclosure of data to other countries.
4. ACCESS TO OTHER NETWORKS

The User may access other network services, including other Internet service providers.
5. NO WARRANTY OF DATA TRANSFER SPEEDS

PRiS makes no warranty of the speed or latency at which data will be transmitted or received across PRiS or connected network services. PRiS makes no warranty with respect to the duration or frequency of unscheduled interruptions in service.
6. RIGHT TO CHANGE TRANSMISSION FREQUENCIES OR SETTINGS

PRiS reserves to right to make changes to the frequency, polarity, or other facets of the wireless transmission technology used. Such changes may require the User to make corresponding changes to settings on User equipment, but will not require the User to acquire new equipment. Any changes in such settings will be solely the User's responsibility.
7. RESPONSIBILITY FOR PRiS EQUIPMENT ON USER PREMISES
The Equipment on the User premises is leased from PRiS. PRiS makes no warranty or representation relating to quality or safety of the Equipment provided. The User releases and agrees to hold PRiS harmless of any and all consequential damage that might arise as a result of using the Equipment. The User agrees to exercise diligence and due care in the use and maintenance of the Equipment. The User agrees to replace, or reimburse PRiS for the full replacement cost of any Equipment which is missing, stolen, damaged by any act of nature or improper use. The User agrees not to move the Equipment from the registered premises without prior consent from PRiS. The User agrees to return to PRiS all the Equipment in good working order immediately upon termination of the Services. In the case of failure to do so, the User agrees to be fully responsible for any costs that are incurred to recover the Equipment, and further agrees to continue to pay full fees for the Connection such time that the Equipment is recovered.
8. TERMINATION OF AGREEMENT

PRiS may cancel this agreement on one month's notice to the User, or without notice where the User does not abide by the terms of the agreement. The User may terminate the agreement at the end of any calendar month by providing notice to PRiS by the 22nd day of that calendar month. A cancellation number, issued by PRiS, will be the only accepted proof of termination.
9. PAYMENT OF FEES AND INTEREST ON UNPAID ACCOUNTS

The User shall pay all costs incurred for the use of the Services payable within 15 days of receipt, failure to do so shall entitle PRiS to treat the User as being in default. Any default by the User shall entitle PRiS to terminate the User's rights under this Agreement, without notice to the User, and without limiting other rights PRiS might have against the User. At the User’s expense a paper statement shall be issued after 30, 60 and 90 days overdue. After 60 days, the account will be suspended until paid in full with a reconnection fee. After 90 days, the account will be sent to collections. All memberships are subject to a 1 month minimum term. If needed, the Services can be Suspended at a reduced rate on a month to month basis. Outstanding unpaid accounts shall be subject to interest rate of 1.5% per month (18% per year).
11. ENTIRE AGREEMENT

This Agreement contains the whole agreement between the parties hereto in respect of the subject matter hereof; there are no warranties, representations, terms, conditions, or collateral agreements, express, implied, or statutory, other than those expressly set forth herein, and in the Acceptable Use Policy referred to herein.
12. RIGHT TO CHANGE AGREEMENT AND POLICY

PRiS may change this Agreement or the Acceptable Use Policy, as it reasonably sees fit, provided that any such change (whether by amendment, addition, or deletion of terms) shall take effect from and after 30 days following the delivery of notice of such changes to the User. Any such notice may be delivered by mail to the User's last known address, by personal delivery, by publication in a local newspaper, or by electronic transmission via the Service.
13. RELEASE FROM CLAIMS

The User hereby agrees to indemnify and hold harmless, PRiS in its entirety, of any and all claims, damages, suits, or actions arising against PRiS from the User's use of the Services.
14. ACKNOWLEDGEMENT

By using this service, the User agrees to be bound by the terms and conditions of this Agreement, and to abide by the Constitution and Bylaws of PRiS.
